In the Wisconsin Court of Appeals case Hennig v. Ahearn, the court held that a party to a contract may assume a duty to "point out" changes in an agreement by its course of conduct during negotiations. This duty goes beyond simply providing a copy to the other party for its examination and may give litigators another tool to challege the validity of agreements.
