March 3, 2014: The legislature will hold a joint legislative committee hearing on SB 632 which regulates a municipality’s ability to regulate frac sand mining and processing operations. This bill is a scaled down version of SB 349 which included a broad preemption of local control over water and air regulation. Although SB 632 fixes the overly broad preemption language, the bill still significantly restricts a local government's ability to determine the location of a frac sand mine or processing facility, set operating hours or regulate the high volume of truck traffic associated with the frac sand mining industry.
